A key innovation of the law is the establishment of autonomous criminal offences specifically targeting the creation, alteration, possession, exhibition, and distribution of counterfeit or falsified artworks. Previously, such conduct was addressed under general provisions of fraud and forgery; the new law provides a tailored and more effective enforcement regime.

The law significantly enhances criminal penalties, introducing imprisonment and substantial financial fines, which may increase in cases involving organized activity, professional involvement, or high-value damages.

Importantly, the scope of protection is broadened to include not only economic fraud but also misrepresentation of an artwork’s origin, authenticity, date, or condition, as well as the prevention and punishment of damage to artworks located in public spaces, museums, and cultural institutions.

In addition, the law establishes a Registry of Certified (Sworn) Art Experts, aiming to ensure reliable authentication processes and enhance transparency in the art market. It also introduces mechanisms for improved monitoring, cooperation among authorities, and prevention of the recirculation of counterfeit works.
